By accessing or using the SiteSnapDoc mobile application and website (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

SiteSnapDoc is a mobile application and web platform designed for construction professionals to capture, organise, and report on site documentation. The Service allows users to take photos, add annotations, upload PDF plans, pin tasks to plan locations, generate professional PDF reports, and share updates with team members and stakeholders.

3. User Accounts

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for safeguarding your account credentials and for all activities that occur under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Upload, share, or distribute any content that is defamatory, obscene, harmful, or infringing on third party rights.
  • Attempt to gain unauthorised access to the Service, other accounts, or computer systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service to transmit malware, viruses, or other harmful code.
  • Resell, redistribute, or sublicense the Service without our written consent.

5. Your Content

You retain ownership of all content you upload, create, or share through the Service, including photos, annotations, notes, plans, and reports ("Your Content"). By using the Service, you grant us a limited, non exclusive licence to store, process, and display Your Content solely for the purpose of providing and improving the Service.

You are solely responsible for Your Content and must ensure it does not violate any third party rights or applicable laws. We do not monitor or endorse user generated content.

6. Intellectual Property

The Service, including its original content (excluding Your Content), features, functionality, design, logos, and trademarks, is and remains the exclusive property of SiteSnapDoc and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

7. Subscriptions and Payments

  • Certain features of the Service may require a paid subscription. Pricing and plan details are available within the app and on our website.
  • Subscriptions are billed in advance on a recurring basis (monthly or annually) depending on the plan selected.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled in accordance with the policies of the platform through which you subscribed (Apple App Store or Google Play Store).
  • We reserve the right to modify pricing with reasonable notice. Price changes will not affect your current billing period.

8. Availability and Modifications

We strive to ensure the Service is available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SiteSnapDoc and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

The Service is provided for documentation and organisational purposes. It is not a substitute for professional engineering, architectural, or legal advice. Users are responsible for verifying the accuracy and completeness of all documentation created using the Service.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the Service will be error free, secure, or available at all times.

11. Indemnification

You agree to indemnify, defend, and hold harmless SiteSnapDoc and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Dublin, Ireland.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data before account deletion by contacting us.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
